Terms of Use

1. The service

Simurgh is operated by Microcis LLC. You can choose an AI expert, describe something you want to learn, build, practice, or solve, work together in a live session, and save a plan and progress to your account. The experts are software systems, not people, and are always identified as AI.

2. Eligibility and accounts

• You must be at least 18 years old to create an account.
• You must provide accurate account information and protect your credentials.
• You are responsible for activity under your account and must notify us promptly if you believe it has been compromised.

3. AI limitations and professional topics

AI-generated speech, plans, code, diagrams, and other material can be incomplete or wrong. Simurgh may help you understand a topic, but it does not replace a licensed professional or your own judgment. Do not rely on it as the sole basis for medical, legal, financial, safety-critical, or other high-stakes decisions. Verify important outputs and seek a qualified human professional when appropriate.

4. Acceptable use

You may not use Simurgh to:

• break the law, facilitate fraud, or harm another person;
• create or distribute unlawful, abusive, hateful, sexually exploitative, or privacy-invasive material;
• impersonate a real person or misrepresent an AI expert as a human;
• upload material you do not have the right to use or infringe another person’s intellectual-property, privacy, or publicity rights;
• probe, scrape, overload, reverse engineer, bypass safeguards, or interfere with the service or another user.

5. Your content and saved work

You keep ownership of the goals, prompts, files, feedback, and other content you submit. You grant Simurgh a limited license to host, process, reproduce, and transform that content only as needed to provide, secure, maintain, and improve the service. You are responsible for having the rights and permissions needed for anything you submit.

AI-generated plans and workspace artifacts are provided for your use, subject to applicable law and any third-party rights. Similar or identical outputs may be generated for other users.

6. Sessions, transcripts, and AI disclosure

Voice and workspace activity is processed to run each session. A transcript, plan, progress record, or other session artifact may be saved to your account. If a feature records raw audio or video, Simurgh will provide a notice when consent is required. You may not remove or obscure the AI disclosure shown for an expert.

7. Plans and collaboration

Saved plans are collaborative working documents, not promises of a particular outcome. You can review, edit, pause, resume, or complete them. Progress depends on your decisions, effort, source material, and circumstances outside Simurgh’s control.

8. Subscriptions and payments

If you purchase a subscription or paid package, the price, included usage, renewal period, cancellation method, and any refund terms will be shown before purchase. Unless the checkout states otherwise, subscriptions renew automatically until cancelled. Taxes may apply. Material pricing changes take effect prospectively after notice.

9. Service changes and availability

We may add, change, suspend, or remove features to maintain security, comply with law, or improve the service. We do not guarantee that every expert, model, feature, or session will always be available or uninterrupted. We will make reasonable efforts to preserve saved plans and notify users of material changes.

10. Intellectual property

Simurgh and its software, branding, expert catalog, interfaces, and platform content are owned by Microcis LLC or its licensors. Except for the limited right to use the service under these terms, no platform rights are transferred to you.

11. Suspension and termination

You may stop using Simurgh at any time. We may restrict or terminate access for a material breach, unlawful use, security risk, nonpayment, or conduct that harms the service or others. Where practical, we will provide notice and an opportunity to export or retrieve saved work. Data is handled after termination as described in the Privacy Policy.

12. Disclaimers and liability

To the fullest extent permitted by law, Simurgh is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Microcis LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, opportunities, or data.

To the fullest extent permitted by law, Microcis LLC’s total liability arising from the service will not exceed the greater of USD 100 or the fees you paid for Simurgh during the 12 months before the event giving rise to the claim. These limits do not apply where the law prohibits them.

13. Governing law

These terms are governed by California law, without regard to conflict-of-law rules, except where mandatory consumer law applies. Disputes must be brought in the state or federal courts located in San Francisco County, California. These terms contain no mandatory arbitration clause and no class-action waiver.

14. Changes and contact

We may update these terms. We will provide reasonable notice before a material change takes effect. If you do not agree, stop using the service. Questions may be sent to privacy@simurghlabs.ai.
